Attorneys representing Donald Trump will be in the U.S. Court of Appeals for the D.C. Circuit on Monday, arguing that the former president has a First Amendment right to malign anyone involved in his federal election interference case. Prosecutors with special counsel Jack Smith’s office will try to convince the panel of three judges that without guardrails on his speech, Trump will intimidate witnesses, incite threats against government employees and distort public understanding of the case.
